The change in status of the beneficiaries (new ones may be entitled to income or principal of the Trust) and the fact that the Trust now cannot be altered are two critical facts that must be communicated to the beneficiaries under California law. At that point, the successor Trustee is expected to either hold or distribute the assets as directed by the Trust instrument. With an average couple, when one spouse dies the Trust becomes irrevocable as to one half of the assets and when the second spouse dies, the entire Trust becomes irrevocable. Upon death, however, the Trust becomes irrevocable, at least in part. Until death, the Trust remains entirely revocable-the Settlor can alter or end the Trust at will. This article concentrates on the latter and includes a basic form required by the California Probate Code.Īs discussed in our article on Wills and Trusts, the average American now uses a revocable intervivos Trust (a “Living Trust”) to avoid the cost of probate when transferring estate assets to the next generation. One of the first duties a Trustee encounters is selecting the professionals to advise and notifying the beneficiaries of the change in status of the Trust. It’s not much harder that handling my own checkbook, really.” “It’s what Doris wanted me to do and I’m really doing no more than listening to professionals giving me suggestions and choices and making the choices. She stopped a moment, a bit surprised, then smiled and agreed. Three years later, as the Trust was filing its annual tax returns and she was directing the CPA as to appropriate tax planning for her allocated distributions, I commented that she had certainly mastered the duties and seemed very comfortable with fulfilling them. This writer well remembers one retired school teacher who at first baulked at the duties she confronted when her sister died naming her as the successor Trustee. Indeed, some courts have held that a Trustee is obligated as part of his or her duties to retain the right advisors immediately so as to accomplish the duties required under the Trust. In reality, the duties, while important, are not beyond the ability of the average person to accomplish if they are wise enough to retain the services of the appropriate advisors which almost all Trust instruments encourage. One who has not previously encountered a fiduciary duty may be overwhelmed by the obligations suddenly imposed, especially during what may be a time of grief. Upon the passing of the Trustor of a Trust, the successor Trustee must assume not only many of the duties previously undertaken by the now deceased Trustee, but often more since most Revocable Intervivos Trusts, upon the death of the people who first created it (the “Trustors” or “Settlors”) require distribution of the assets to the next generation or other people.

Sigmund Freud viewed hedonic motivation as people tend to look at the long-term pleasure/happiness of things and would rather take the immediate discomfort if they know they will have a pleasurable outcome later on, also known as the reality principle. Examples of utility is money because it increases a person's happiness. He also believed in the phrase principle of utility which is an idea that people choose their actions based on if it increases or decreases their happiness. Bentham believed in decision theory in which of all the possible end-states, which one would we choose? As people weigh pros and cons of each outcome, people will choose the one with the most positive outcomes. To go off on Hobbes’ views, Jeremy Bentham believed people are slaves to pleasure and pain and that hedonic motivation is determined by positive or negative consequences. Our learned remembrance on whether something was pleasurable or unpleasant sets our motivation to approach that event. Thomas Hobbes’ viewed hedonic motivation as people tend to approach pleasurable/positive environmental events and avoid painful/negative environmental events, also known as incentive motivation. His take on hedonic motivation was that people have their own definitions on what is pleasurable and painful to them.Įpicurus viewed hedonic motivation as that pain and pleasure eventually even out and people learn how to do things in moderation.Īs these early views of hedonic motivation took place, later philosophers also took an interest in their own interpretations. He viewed it as a person should follow a course of action for which pleasure exceeds pain and if a person does not follow that path, it is because they do not fully understand the knowledge of the pleasure or pain that can result.ĭemocritus viewed hedonic motivation along the same lines as Socrates’, but he did not have a defining definition of what was pleasurable and what was painful besides that people enjoy pleasure and people avoid pain. Socrates was one of the first few people to start interpreting Hedonic motivation. Different views Īs the term "hedonic motivation" occurred, different types of interpretations and views also occurred as well. For example, hedonic goods are bought so that the consumer may gain pleasure and enjoyment from the good, and value experiences are also viewed as hedonic experiences. This is interesting because even though hedonic motivation incorporates the pursuit of pleasure as well as the avoidance of painful situations, the concept has been traditionally linked to the positive connotation of pleasure. The root word hedonic comes from the Greek word for “sweet”, which means relating to or characterized by pleasure. Historically, approach and avoidance motivation have been linked to the hedonic characteristics of pleasure and pain. According to the hedonic principle, our emotional experience can be thought of as a gauge that ranges from bad to good and our primary motivation is to keep the needle on the gauge as close to good as possible. This is linked to the classic motivational principle that people approach pleasure and avoid pain, and is gained from acting on certain behaviors that resulted from esthetic and emotional feelings such as: love, hate, fear, joy, etc. Hedonic motivation refers to the influence of a person's pleasure and pain receptors on their willingness to move towards a goal or away from a threat. Many of these (Leadville, Idaho Springs, Breckenridge) remain some of the state’s top destinations, while the abandoned others simply became eerily atmospheric ghost towns. What: Gold fever roared through Colorado in the late 1800's, sparking instant towns for the thousands of starry-eyed workers swayed by the promises of riches. Wander through Colorado’s lonely ghost towns Most fabulous are the hiking and biking trails for journeying through the sculpted rocks, the visitor’s centre for watching free "best of" Red Rocks concert footage, and the Colorado Music Hall of Fame for its excellent interactive displays that showcase the state’s diverse musical history. Highlights: While the star-studded concerts get all the love at this awesome park, there’s also plenty of first-rate attractions. Big-name acts that have performed here include The Beatles (1964), The Jimi Hendrix Experience (1968), Jethro Tull (1971) Bruce Springsteen (1978), The Grateful Dead (1978), U2 (1983), Radiohead (2003), and Daft Punk (2007). As the undeniable superstar of Red Rocks Park, it sits at 6,450-feet above sea level and comes with two massive monoliths - Creation Rock and Ship Rock - that control the incredible sound. What: Given its near-perfect acoustics, it’s easy to see why this 9.000-seater amphitheatre set in a transitional zone where the Great Plains meets the Rocky Mountains is hailed as one of the best live music venues on the planet. Join (or lose) the crowds at Red Rocks Park & Amphitheatre We discover the best things to do in a place where being at a high altitude just makes things more fun. Complete with epic natural wonders, endless ski runs, gurgling geothermal waters, and historic towns with echoes of the Old West, Colorado is the outdoorsy mountain state that draws in urbanites, seasoned adrenalin-lovers, and have-a-go adventurers. Eventually, when William the Conqueror became King of England, he retained the 5400-grain pound for minting coins, but reverted to the 7200-grain pound for other purposes. While England also adopted this measure, a shortage of silver caused King Offa to reduce the measurement of the pound to 5400 grains in order to use smaller coins. As a result, a pound, 16 ounces of silver, or 7200 grains, became a commonly used measure in many regions. Over time, trade spread from the Mediterranean area to Europe, including the northern German City States. Ten dirhems comprised a Wukryeh, which was translated into Latin as an "uncia" – the origin of the word "ounce." They used a coin called a silver dirhem as a basic measure of weight, which had a weight roughly equivalent to 45 fully grown grains of barley. The Arabs used coins as a measurement of units of weight since a minted coin could not easily be cut or shaved to reduce its weight, and thus provided a measurable standard. In the eighth and ninth centuries of the Common Era (CE), Arab civilization flourished in the Middle East and Spain. As such, many unit converters including this Conversion Calculator exist, and will continue to do so to ensure that people globally are able to communicate different measurements effectively. Since US customary units (USC) are so entrenched in the United States, and SI is already used in most applications where standardization is important, everyday use of USC is still prevalent in the United States, and is unlikely to change. This is partly due to the substantial financial and cultural costs involved in changing a measurement system compared to the potential benefit of using a standardized system. Although SI is used almost universally in science (including in the US), some countries such as the United States still use their own system of units. The International System of Units (SI) is the standard metric system that is currently used, and consists of seven SI base units of length, mass, time, temperature, electric current, luminous intensity, and amount of substance. Today, some of the systems of units in use include the metric system, the imperial system, and the United States customary units. As such, the development of more universal and consistent systems developed over time. While this may work on a local level, when considering trade, as well as science, having systems of units based on units that others may not be able to relate to or understand makes interaction difficult. In the past, many systems of measurement were defined on a local level, and could be based on factors as arbitrary as the length of a king's thumb. A unit of measurement is a defined magnitude of a quantity that it used as a standard for measurement for the same kind of quantity, such as measurements of length, weight, and volume. Historically, many different systems of units have been used, where a system of units is defined as a collection of units of measurement with rules that relate them to each other. The parent provides a model for keeping one’s cool, but no overt incentives for doing so-the kid becomes a person who is self-regulating, kind, and conscientious because she wants to be, not because it will result in ice cream. The gently parented child, the theory goes, learns to recognize and control her emotions because a caregiver is consistently affirming those emotions as real and important. The gentle parent holds firm boundaries, gives a child choices instead of orders, and eschews rewards, punishments, and threats-no sticker charts, no time-outs, no “I will turn this car around right now.” Instead of issuing commands (“Put on your shoes!”), the parent strives to understand why a child is acting out in the first place (“What’s up, honey? You don’t want to put your shoes on?”) or, perhaps, narrates the problem (“You’re playing with your trains because putting on shoes doesn’t feel good”). It has no official doctrine: writing in the Times, Jessica Grose called the approach “a sort of open-source mélange, interpreted and remixed by moms across the country.” It doesn’t even have an official name-“gentle parenting” is a catchall for variations that include “respectful parenting,” “mindful parenting,” and “intentional parenting.” In its broadest outlines, gentle parenting centers on acknowledging a child’s feelings and the motivations behind challenging behavior, as opposed to correcting the behavior itself. But that was it: “Hurry up! You’re making us late!” As someone whose morning exercise takes the form of a power struggle over when and under what circumstances my five-year-old will put down his trains, put on his shoes, and leave for school, I knew, reading Delahooke, that I had entered a reality-distortion field, but I wasn’t sure which one of us was the agent of distortion.ĭelahooke’s recommendations in “Brain-Body Parenting” hew closely to the child-rearing philosophy commonly known as “gentle parenting,” which has been the vogue among vigilant, trend-aware P.M.C. I skimmed ahead for further disclosures of Delahooke’s authoritarian tendencies. I went back and reread the paragraph from the beginning. “When my body budget was in a deficit,” she writes, “I’d sometimes say things I later regretted, projecting my own lack of internal resources onto my kids: ‘Hurry up! You’re making us late!’ ” Stress and exhaustion, she goes on, “turned me into an authoritarian and controlling mom.” She recalls a time when her three daughters were young and she often felt overwhelmed. Not far into her new book, “ Brain-Body Parenting” (Harper Wave), the child psychologist Mona Delahooke makes a confession.
